Declaration Under Uniform Child Custody Jurisdiction and Enforcement Act (UCCJEA)
Form FL-105 is filed with every initial custody or visitation request. It gives the court a five-year residence history for each child, any other custody cases, and any restraining orders that are in effect. It is signed under penalty of perjury, and there is a continuing duty to update the court if new information arrives after filing.

Gather this first
- ✓Each child's full legal name, date of birth, and place of birth
- ✓A five-year residence history for each child — every address, with dates and who the child lived with
- ✓Information about any other court case involving custody or visitation of the children
- ✓Information about any domestic violence restraining orders currently in effect
- ✓Names and addresses of anyone else who has or claims custody or visitation rights

Court identification and case number
The county, court name, and branch — found on the California Courts website or on the underlying petition — plus the Petitioner, Respondent, and case number.
- Item 1–2
Declarant status and children
Your relationship to the custody proceeding, and each child subject to the case: full name, date of birth, and place of birth. More than four children go on an attachment.
- Item 3
Five-year residence history
Where each child has lived for the past five years, with dates, addresses, and who the child lived with. If the children have not all lived together, Form FL-105(A) is completed for each child whose history differs.
- Item 4–5
Other proceedings and restraining orders
Any other custody-related cases (family, adoption, juvenile, or other), and any domestic violence restraining or protective orders currently in effect.
- Item 6
Third-party custody or visitation claims
Anyone other than the parties who has physical custody of a child or claims custody or visitation rights, with their name and address.
- Final
Signature and final checklist
The declaration is signed under penalty of perjury. The guide closes with a full pre-filing checklist and an explanation of the continuing duty to inform the court of new information.
